Biocidal Products Law / REACH
The regulations on biocides are increasingly becoming subject of administrative actions and unfair competition disputes. The demarcation of biocides from other product types, in particular processing aids and food additives, medicinal products, cosmetics and pesticides poses constant problems. Furthermore, the authorization of biocides involves many issues (for example on-site manufacturing of biocides). Correct labeling and restrictions on advertising are also important aspects. Related to the laws on biocides is the European regulation on chemicals (REACH) which establishes comprehensive obligations for registering chemicals. REACH raises a vast number of legal issues. One main focus lies on the scope of the regulation, in particular with regard to health care products (medicinal products, cosmetics, foodstuffs).
